Indian citizens visiting the United States on a tourist visa may be able to remain in the country longer if they meet the eligibility requirements for an extension of stay.

For visitors travelling under the B-2 tourist category, the extension request is generally made through Form I-539, Application to Extend/Change Nonimmigrant Status, filed with U.S. Citizenship and Immigration Services (USCIS).

However, having a valid tourist visa does not automatically mean a traveller can stay in the US until the visa's expiry date.

I-94 is more important than the visa expiry date

One of the most important points for Indian tourists in the US is the distinction between the visa validity period and the authorised period of stay.

A US visa allows a traveller to request admission at a port of entry. Once admitted, the traveller's authorised stay is recorded in the Form I-94.

Therefore, visitors should check their I-94 record carefully to know the date by which they are required to leave the United States.

How can Indians extend their stay?

Eligible B-2 visitors can request an extension by submitting Form I-539 to USCIS.

Applicants generally need to explain:

  • Why they need additional time in the US

  • Why the extended stay will remain temporary

  • Their plans to leave the country after the additional period

  • How the extension could affect their employment or residence in their home country

  • Their current immigration status and supporting documentation

The original or required information from the Form I-94 must also be provided as part of the application.

When should Form I-539 be filed?

US government guidance recommends applying for an extension at least 45 days before the authorised stay expires, if possible.

USCIS instructions say the application should generally be submitted before the current authorised stay expires. The instructions suggest filing at least 45 days before expiry and generally no more than six months in advance.

Visitors should therefore avoid waiting until the final days of their authorised stay.

Does applying for an extension guarantee approval?

No.

Submitting Form I-539 does not automatically guarantee that the extension will be granted. USCIS considers whether the applicant meets the relevant eligibility requirements and whether the request is supported by a legitimate temporary reason.

Applicants should also provide appropriate evidence supporting their circumstances and their intention to leave the US after the requested additional period.

Can every visa holder use Form I-539?

No.

Form I-539 is used by eligible nonimmigrants seeking an extension or change of status, but not every nonimmigrant category qualifies.

USCIS specifically lists categories and situations in which Form I-539 cannot be used. Visitors should therefore check the current USCIS instructions before filing.

Visa extension vs stay extension: What's the difference?

These two terms are often confused.

A visa is primarily used to seek admission to the United States. The period a visitor is actually authorised to remain in the country is determined at admission and recorded through the I-94.

An extension of stay, on the other hand, is a request to USCIS to allow the person to remain in the US beyond the current authorised period.

So, a traveller does not simply extend the visa stamp in their passport by filing Form I-539.

What happens if a visitor overstays?

Visitors should take the I-94 expiry date seriously.

Remaining in the US beyond the authorised period without lawful status can create immigration problems and may affect future travel or visa applications.

For this reason, visitors who believe they need additional time should consider the extension process well before their authorised stay expires.
